Terms of Service

1. What this is

Berges AI is a chat service built on third-party open-weights language models. You send messages, models generate replies, we route between a fast model and a thinking model behind the scenes.

It's a tool. It is not a substitute for professional advice (medical, legal, financial, psychological, or otherwise). Don't rely on it for decisions that matter without independent verification.


2. Your account

  • One account per person. Don't share it.
  • You must be at least 16 years old to use Berges AI.
  • You're responsible for what's sent from your account. Keep your sign-in email private — anyone with the magic link can sign in once.

We may suspend or close any account at our discretion — for example, for terms violations, abuse, suspected fraud, non-payment, or operational/legal risk.


3. Acceptable use

Don't use Berges AI to:

  • Generate or distribute illegal content (CSAM, terrorism content, etc.).
  • Harass, dox, or threaten any person.
  • Generate large-scale spam, scams, or disinformation.
  • Attempt to reverse-engineer the system, scrape it, or evade rate limits.
  • Pretend AI output is human-written in contexts where that matters (academic submissions, journalism, legal filings, etc.).

You're responsible for the consequences of how you use the output.


4. AI output disclaimer

Language models make things up. They can be wrong. They can be confidently wrong. They may produce output that's biased, offensive, or factually incorrect.

We do our best to reduce that — through model choice, system prompts, and the interceptor layer — but no AI is perfect. Verify anything important.

The output is provided "as is". We make no warranty that it's accurate, complete, or fit for any specific purpose.


5. What you own, what we own

You own what you write to the assistant. You also own what comes back to you in response — to the extent the underlying model providers' licenses allow, which generally means you can use it freely for any lawful purpose, including commercially.

We own the software, the interface, the cascade architecture, and the Berges interceptor designs. You don't get any rights to those beyond using them through the service.

The open-weights models we route to are licensed by their respective creators (Mistral, Qwen, DeepSeek, MiniMax, etc.) under their respective open-source licenses.


6. Subscriptions and payment

  • Paid plans are monthly, auto-renewing. We process payments through Stripe.
  • You can cancel anytime from the Account page. Cancellation takes effect at the end of the current billing period — you keep access until then.
  • We don't issue refunds for partial months. If something's broken on our end, email us and we'll work it out.
  • We may change prices, plans, included features, and usage limits at our discretion. For a price increase affecting an active subscription, we'll give at least 30 days' notice by email; your subscription renews at the new price unless you cancel before the effective date.

EU consumers — right of withdrawal. If you're a consumer in the EU, you have a statutory right to withdraw from a purchase within 14 days of subscribing, without giving any reason. To exercise it, email dan@bergesinstitute.com within 14 days of your initial paid period and we'll refund what you paid for that period. By starting to use the paid service during the 14-day window, you expressly request that we begin performance immediately and you accept that your right of withdrawal ends once the service has been fully provided for that period.


7. Free tier

The free tier exists so you can try the service. It's intentionally limited (10 messages per month at time of writing). The limit, the included features, and the existence of the free tier may change.


8. Service availability

We aim to keep Berges AI running, but we make no uptime guarantee. The service depends on third-party model providers; if they have an outage, we will too. We're not liable for downtime, lost output, or business interruption.


9. Limitation of liability

To the maximum extent allowed by law:

  • We're not liable for any indirect, incidental, or consequential damages arising from your use of the service.
  • Our total liability to you for any direct damages is limited to the amount you've paid us in the 12 months before the claim, or €100, whichever is greater.

10. Termination

You can stop using Berges AI anytime by canceling your subscription and deleting your account.

We can suspend or terminate any account at our discretion at any time — including (without limitation) for terms violations, abuse of the service, suspected fraud, non-payment, or operational/legal risk. We'll usually warn you first when practical; we may act without notice when the violation is severe or warning would be ineffective.

If we terminate a paid subscription without cause (i.e. not because of a violation, abuse, non-payment, or fraud), we'll refund the unused portion of the current billing period on a pro-rata basis.


11. Changes to these terms

If we materially change these terms, we'll notify active subscribers by email and update the effective date. Continued use after a change means you accept the new terms.


12. Governing law

These terms are governed by the laws of Spain. Disputes will be resolved in the courts of Madrid, unless local consumer protection law overrides this.
